User Agreement
Date of publication: 03 December 2025
Language and priority of versions. The official and legally binding version of this Agreement is the Ukrainian version. Translations into other languages are provided solely for user convenience. In the event of discrepancies, the Ukrainian version shall prevail.
1. Who we are and how these terms work

The website and services available at https://bitovki.in.ua (hereinafter — the “Platform”) are provided to Users for posting and searching listings (“Offers”) in the field of in the field of modular buildings and container solutions. The Platform may also publish Offers from related categories of construction machinery and equipment. The Platform may also display Offers from related categories of construction machinery and equipment.
This User Agreement (hereinafter — the “Agreement”) governs the relationship between the Operator and all persons using the Platform. The Privacy Policy and the Cookie Policy are integral parts of this Agreement.
We are a platform, not a seller.
The Operator is not a party to any transactions between users and suppliers/dealers, does not accept payments for goods/services, and is not responsible for their quality, delivery deadlines, installation, or compliance with descriptions.
2. Definitions

Agreement — this User Agreement, governing the use of the Platform.

Account (Personal Cabinet) — a User’s account on the Platform, created directly on the Platform or via simplified authorization (SSO), if available. The Account is used for identification, posting Offers, and accessing functions requiring authorization.

User — any person using the Platform.

Dealer/Supplier — a user posting Offers.

Buyer/Client — a user who requests information or places an order with a Dealer.

Offer — a listing (text, photos, characteristics, price/conditions).

User Content — any material uploaded by the user (texts, photos, videos, reviews, etc.).
3. Registration and Account
3.1. An Account is required to publish Offers and to use features requiring identification. The User guarantees that they are at least 18 years old and possess the necessary legal capacity.
3.2. The User must provide accurate data and keep it up to date. The User is responsible for safeguarding their login/password; any actions performed from their account are deemed their actions.
3.3. The Operator may suspend/block/delete an account if the Agreement, applicable law, or third-party rights are violated, or if there are justified suspicions of fraud/manipulation or threats to information security.
3.4. Viewing the Platform is available without registration. To publish Offers and use features requiring identification, an Account is required. When creating an Account or filling out forms, the User must provide accurate data and update it when necessary. The list of data collected is determined by the Platform’s forms and the Privacy Policy.
3.5. Security and abuse prevention. The Platform maintains technical logs and applies anti-fraud measures (including calculation of HMAC hashes of technical data — IP addresses/device identifiers — using a secret key). These data are not used for direct identification and are applied solely for access protection, rate limiting, and incident analysis. Details are provided in the Privacy Policy.
3.6. Account deletion. Deleting an account means stopping its use and stopping the display of related data on the Platform. Certain data may be retained to the extent and for the duration required to fulfil legal obligations and ensure Platform security.
4. Offers and Content
4.1. Requirements for Offers and Content:

must be accurate and comply with applicable laws of the laws of Ukraine; no misleading information;

Photos: no watermarks, advertising texts, or “hidden contacts” (phone, e-mail, links, @username, QR codes); no images of documents, invoices, tracking numbers; vehicle plates and faces of third parties must be blurred/hidden without consent. Factory labeling or serial plates are allowed if they do not contain personal data.

descriptions may include external links displayed as plain text (not clickable). Prohibited: contacts (phone, e-mail), communication links (mailto:, tel:, t.me/wa.me, viber:// etc.) and short links. Moderation may remove suspicious or harmful links.

no prohibited content: counterfeit goods, weapons, explosives, hazardous materials, copyright-infringing materials, hate speech, pornography, personal data of third parties without consent, etc.
4.2. The Operator moderates content before/after publication and may:

refuse publishing, hide, or delete an Offer/content without explanation;

change the display order, including temporary hiding during review;

correct obvious technical errors (typos, incorrect categorization).
4.3. The User guarantees that they possess the necessary rights to the uploaded content and indemnifies the Operator against claims from third parties.
5. License for User Content and Public Use
The User grants the Operator a non-exclusive, royalty-free, worldwide license to User Content for the following purposes: (i) display and distribution on the Platform; (ii) technical processing and adaptation (resizing/cropping, previews/thumbnails, compression, translations/localization of descriptions); (iii) marketing communications and promotion of the Platform, including publications on social media, advertising systems, e-mail campaigns, and press materials; (iv) presentation of Platform case studies/portfolio.
The Operator may sublicense these rights to contractors, hosting providers, and advertising/media partners solely for the purposes listed above.
Publications on third-party platforms. The Platform may publish Offer materials on external websites/marketplaces/social networks/advertising systems.
Term: the license is valid for the period of publication on the Platform and for 24 months after deletion — for marketing, portfolio, and legal reporting purposes; backup copies and logs may be retained according to retention periods. The User may request to limit further marketing use by contacting support@bitovki.in.ua; this does not affect previously published materials.
User warranties: by uploading content, the User confirms possessing all necessary rights and consents (including for images of persons/objects) and confirms no violation of third-party rights.
6. User Interactions
6.1. Requests/orders are generated on the Platform and transmitted to the Dealer. Further negotiations, contracting, delivery, installation, warranty obligations, and payments are the responsibility of the Dealer and the Buyer.
7. Paid Services
The Platform may provide paid services. Conditions, functionality, pricing, duration, and payment/refund rules are displayed during the service ordering process. Using a paid service means acceptance of its terms. Paid services are non-refundable unless required by law or by the terms of that specific service. In case of a technical billing error, the Operator will correct/return the funds.
8. Platform Rights and Usage Restrictions
All rights to the Platform and its contents (code, design, database, logos, etc.) belong to the Operator or are used legally. The User receives a limited, revocable, non-exclusive license to use the Platform within its normal functionality. Any other use (including automated access, data extraction, circumvention of protections, modification/decompilation, sharing access) is prohibited.
9. Limitations and Liability
To the maximum extent permitted by law, the Operator is not liable for any indirect damages, penalties, or loss of profit.
The Operator’s total liability for any claims is limited to the amount actually paid by the User for paid services during the three (3) months preceding the claim, and if no such payments exist — 0.
9.1. The Platform is provided “as is”. The Operator does not guarantee uninterrupted/error-free operation, compatibility with the User's devices/software, or absence of harmful components.
9.2. The Operator is not liable for:

actions/inactions of Dealers and Buyers, quality of goods/services, fulfilment of deadlines and obligations;

accuracy and relevance of Offers, any losses resulting from their use;

failures caused by third parties (hosting providers, communication providers, etc.).
10. Force Majeure
The parties are exempt from liability for partial/complete non-performance caused by force majeure: war, strikes, blockades, fires, floods, epidemics, government actions, power outages/data center failures, DDoS attacks, and other circumstances beyond reasonable control. Deadlines are extended for the duration of the force majeure.
11. Dispute Resolution and Governing Law
11.1. Pre-trial procedure: before filing a lawsuit, the User must send a claim to support@bitovki.in.ua or via the support form. Response time — 30 calendar days.
11.2. Governing law: the laws of Ukraine. Jurisdiction: courts at the Operator’s place of registration (Kyiv).
12. Amendments
The Operator may amend the Agreement. The current version is published on the Platform with a date stamp. Amendments apply from the date of publication. Continued use of the Platform after publication constitutes acceptance of the updated Agreement.
13. Miscellaneous
13.1. Invalidity of any provision does not invalidate the Agreement as a whole; such provision shall be replaced with one that most closely reflects its meaning.
13.2. Failure by the Operator to act in the event of a User’s breach does not constitute a waiver of the Operator’s right to act later.
13.3. Change of Operator and succession. In case of reorganization, sale of the project, or transfer of rights and obligations to a new entity, all rights and obligations pass to the successor. The Operator (or successor) notifies users through publication of the updated Agreement and/or a message on the Platform. The User may discontinue using the Platform if they do not agree with such transfer.
